Chennai High Court upheld the selection of 463 staff nurses at JIPMER

Madras HC upheld the selection of 463 staff nurses to JIPMER in Puducherry.
Chennai: The Madras HC has upheld the selection of 463 staff nurses to Jawa­harlal Institute of Post Graduate Medical Educa­ti­on and Research (JIPMER) in Puducherry.
A division bench, comprising justices N. Paul Vasa­nt­hakumar and R. Mah­ade­van, dismissed a petition filed by P. Tamiz­ha­r­a­s­an, an unsuccessful candidate, seeking a CBI probe into the alleged irregularities and malpractices in the selection of staff nurses in JIPMER.
Holding that the allegations of mala fide need proof of a high degree, the bench said, “Mere allegation or a vague or bald statement is not sufficient. It must be demonstrated either by admitted or proved facts and circumstances obtai­na­ble in a given case.”
The petitioner claimed that usually written exa­m­inations are held only in Puducherry, but this time, it was held at Pudu­cherry, Chennai, Tiruchy and Thiruva­nanth­apur­am in September. Of the 465 selected candidates, 330 were from centres in Thiruvananthapuram.
Pointing to the averments in the counter-affidavit of JIPMER that out of the 463 vacancies, 159 can­di­dates who appeared in the Thir­uvan­ant­hap­ur­am centres were selected, the bench said the allegation made by the petitioner that 330 candidates out of 465 who passed were selected from the Thir­uvan­­anthapuram centres had no basis.
Further, vague allegations were made against the administrative officer who was not made a party.
The averments made in the representation to the Union government and in the affidavit by the petitioner were disproved by JIPMER which filed a detailed counter-affidavit giving details of the examination held and number of persons who appeared and were selected in the examination through the centres.
Moreover, a similar PIL filed by another unsuccessful candidate had already been dismissed with an observation that allegation of mala fide against persons must be specific and strictly proved, the bench added.
