Madras HC asks medical university to conduct practical examinations for doctor after 15 year.
Chennai: The Madras High Court has directed the Tamil Nadu Dr MGR Medical UniverÂsity to conduct practical examinations again for a woman who failed in her MD examination 15 years ago.
On an appeal from the university, a division bench, comprising justices N. Paul Vasanthakumar and R. Mahadevan, directed the university to conduct the practical examination within four weeks.
Challenging a February 2007 order of the university, Dr R. Devika had filed a writ petition, praying for a direction to the university to issue a revised marksheet by disclosing the marks secured by her under the sub-heads of practicals.
She also sought to declare her as passed in the MD (Obstetrics and Gynaecology) part-II examination if she had secured an aggregate of 350 out of 700 after adding the marks secured under the sub-heads. She had obtained only a total of 346 marks.
A single judge had allowed her plea. Hence, the university filed the present appeal. The university submitted that 350 marks out of a total 700 was the minimum required mark for a pass. Dr Devika failed to get the minimum marks.
Marks were awarded cumulatively between 1993-94 and no separate marks needed to be awarded under each head. Modifying the single judge’s order, the bench directed the university to conduct the practical part-II MD exam for Dr Devika and awarding appropriate marks.
