High Court upholds TN bar council’s order

Madras high court upholds order of the BCT regarding suspension of an advocate from practice by the BCT.
Chennai: The Madras high court upheld an order of the Bar Council of Tamil Nadu (BCT), suspendi­ng an advocate from pr­actice, for allegedly co­n­ducting fake courts and even passing ord­e­rs on petitions that litigants brought before him.
Justice K. K. Sas­idh­aran who dismissed the petition from advocate R. K. Vijay Anand, one among the five suspended lawyers, held that the power of the Bar Council to revoke the license to practice permanently or suspend it for a fixed term, would include the incidental power of interim suspension, pending disposal of disciplinary proceedings for misconduct.
The judge said the string of materials av­ailable on record made the position very clear that the petitioner al­ong with other advoca­tes, had indulged in ill­egal and unethical pra­ct­ices and their actions had tarnished the im­age of this noble pr­o­fes­sion.
These materials were sufficient to pa­ss an order of interim suspension. The dis­c­i­­plinary committee mu­­­­st make eff­orts to di­s­pose the suo mo­tu disciplinary pr­oce­edings as expediti­ously as possible, the judge added.
