Hyderabad: The department of personnel and training of the Centre has been sitting on the request for permission to prosecute five all India service officials named in the Y.S. Jagan Mohan Reddy quid pro quo investments case and other major cases.
A CBI source said that they are waiting for nod from the Centre as it is mandatory. “We have got only permission to prosecute IAS officials Y. Srilakshmi and Venkatrami Reddy and IRAS Brahmananda Reddy,” said a CBI source. Section 19 of the Prevention of Corruption Act makes it mandatory to obtain government sanction before prosecuting public servants. In April 2014 the Centre gave the nod to prosecute IAS officer G. Venkatrami Reddy.
He was named as an accused in the Ramky Pharma City case. In March 2013 the Centre gave permission to prosecute Y. Srilakhsmi in the Obulapuram illegal mining scam. The court has taken cognizance of the case against IAS officials under IPC sections but no cognizance was taken under the PC Act. In 2013 the Centre gave permission to prosecute IRAS officer K.V. Brahmananda Reddy in the Vanpic case. IAS official Ratnaprabha was cleared by HC.
The CBI is yet to secure sanction in prosecuting IAS officers like B.P. Acharya, L.V. Subramanyam, Manmohan Singh, M. Samuel, Adithya Nath Das, B. Sam Bob and Muralidhar Reddy. The CBI does not need prosecution permission for IAS officials who had retired like K.V. Rao involved in the Emaar scam.
Mr Manmohan Singh is accused in the Vanpic aspect of the Jagan assets case. M Samuel is an accused in the Vanpic, Lepakshi and India Cements chargesheets in the Jagan assets case. Aditya Nath Das is accused in the India Cements episode while Sam Bob is accused in the Indu Tech Zone case. Muralidhar Reddy is an accused in the Lepakshi and Indu Tech Zone cases. The State rejected prosecution sanction for Mr. L.V.Subramanyam (former Secretary, Industry) in the Emaar Properties case.
