Mysuru: The daughter of a retired IAS officer, who has charged her in-laws with dowry harassment and rape, has filed an application before 7th Additional District and Sessions Court Judge to allow her advocate to make submissions along with the public prosecutor, while hearing the anticipatory bail petition of the main accused, Dr Prabhudha Harsha Murthy.
The application was filed on Wednesday when Judge Roopa Nayak was hearing Prabhudha’s bail petition. The Judge later posted the case for Thursday. The applicant has stated that she does not have confidence in the investigating officer. She pointed out that his behaviour during her visit to their house in VV Mohalla for the spot mahazar was unbecoming. He was seen mingling freely with the relatives of the accused and their advocate Arun Kumar.
Though she had made her statement before the police and magistrate, the officer has been sending repeated notices insisting her to appear before him and even CID. She had already lodged a complaint against the investigating officer in this regard with the Director General of Police. Hence she was submitting an application, under Section 301 (2) of CrPC, to allow her advocate to appear before the judge and present his arguments, she stated.
Meanwhile, advocate Arun Kumar on Wednesday afternoon filed his objection against the application filed by IAS officer’s daughter questioning her intent. He said the application was filed at this juncture to delay anticipatory bail for Prabhudha.
