Madras High Court Bench sees ‘bar’ to deliver justice on time

Bench said no one can doubt the requirement of early justice, but the mismatch between makes task difficult

Chennai: The Madras high court has observed that the action of the bar (advocates) often obstructs the requirement of adequate strength of judges to improve the management and functioning of the system. (Apparently, the court was referring to the bar interference whenever the list of names to be appointed as judges are recommended and stalling its process one way or the other.)
A division bench, comprising Chief Justice Sanjay Kishan Kaul and Justice T.S. Sivagnanam made the observation while disposing of a public interest litigation (PIL) from A.R. Kumar, which sought to direct the registrar general of Madras HC to maintain a diary in each and every court and give specific dates for each and every case for hearing and to prescribe the outer time limit for disposal of
pending cases before the court.
The bench said no one can doubt the requirement of early justice, but the mismatch between inflow of cases and the judges’ strength makes the task difficult. The case management techniques undoubtedly help in improving the system and P. Vijendran, counsel for the petitioner, has handed over the consultation paper on case management of the law commission.
These were all matters which have been examined on the administrative side, and the implementation of the process was already on. “We have, thus impressed upon the counsel for the petitioner that existence of the malady is not in doubt, but solutions have to be given to improve the management and the functioning of the system. Most importantly adequate judges strength is required which is often obstructed by the action of the bar,” the bench added.
