Cases filed against KCR not strong

It is very difficult for the investigation agencies to place the evidence

Hyderabad: Legal experts opined that the cases which are lodged by the TD leaders in various police stations across AP against TS Chief Minister K. Chandrasekhar Rao and YSR Congress president Jagan Mohan Reddy allegedly conspiring to destabilise the AP state government may not be stand before the court of Law.

The TD leaders and workers lodged complaints against Mr Chandrasekhar Rao and Jagan Mohan Reddy under Sections of 464 (A person is said to make a false document or false electronic record), 469 (Forgery for purpose of harming reputation) 471 (using as genuine a forged or electronic record] 166, (public servant disobeying law, with intent to cause injury to any person),167 (public servant framing an incorrect document with intent to cause injury) and 120 (B) ( criminal conspiracy) of the IPC. According to C. Malleswar Rao, criminal lawyer, these are all acts of after thought of a case lodged by the ACB against Revanth Reddy and revelation of some audio tapes of conversations between Mr Naidu and Mr Stephenson.

N Sridhar Reddy, High Court advocate opined that these cases may useful for some time as a counter attack against political rivalries, but it is very difficult for the investigation agencies to place the evidence before the court of law to prove the offences.

Malleswara Rao said that “if facts of a complaint not couple with the prima facie evidence , the courts will not take cognizance of such offences. “

C Nageswara Rao, former public prosecutor of erstwhile AP opined that there several instances where the courts have turn down the cases foisted against the political leaders with political motives.

Terming the act of the TD as childish and premature, he said “it is not the way to defend the TD to the case against its MLA with regard to bribing the TRS MLA for the MLC polls. If at all the TD has any evidence of illegal tapping of phone of TD leaders they have to place the evidence before the court of the law and take legal recourse against the persons indulging in the act.

P Veera Reddy, senior counsel of the High Court said “I strongly believe that theses cases will drops even at the registrations stage. Even if they register by the police, the High Court will quash all the FIRs, as and when either Chandrasekhar Rao or Jagan Mohan Reddy approaches it under Section 482 of the Cr PC.”
