Nisham’s friend moved the court for him and sought custody of the vehicle

Kochi: Kerala High Court on Friday refused to release the Hummer driven by Muhammed Nisham when it mowed down and killed a security guard.
The court held that the four-wheel drive worth Rs 1.5 crore was used as a weapon for committing the offence. Recently, social media was abuzz with pictures of Nisham’s Hummer which was getting ruined at the police station. Car enthusiasts shared the picture but no one showed any remorse on the condition of the car.
Chandrabose, the security guard, succumbed to the injuries he sustained in the incident.
Interestingly, Nisham’s friend moved the court for him and sought custody of the vehicle. Police, however, informed the court that the vehicle was purchased by the accused.
Justice B. Kemal Pasha rejected the plea and asked the petitioner to approach the trial court for getting the order. The friend, on behalf of Nisham, contended that the vehicle, which presently has a cost value of Rs 1.5 crore, will get ruined in case it is continued to be kept in the open at the police station.
“The car that was used as a weapon for committing the offence has to be considered. The said car is a material object in the case and the same has to be identified by the witnesses,” the court observed.
