The CBI had filed a false and fabricated chargesheet says court

NEW DELHI: A Special CBI court on Thursday rapped the CBI by discharging ex-telecom secretary Shyamal Ghosh and three telecom firms who had been chargesheeted by the CBI in connection with the 2002 additional spectrum scam case. The court while discharging Mr Ghosh and three firms said the CBI had filed a false and fabricated chargesheet against them and was trying to mislead the court.
“The chargesheet filed by the CBI is full of distorted facts. The director of the CBI should conduct an inquiry over against the erring CBI officials for filing false and fabricated chargesheet and attempting to mislead the court. There were no incriminating evidence against any of the accused,” the court noted. Mr Ghosh and three telecom firms — Hutchison Max(P) Ltd, Sterling Cellular Ltd and Bharti Cellular Ltd — were chargesheeted in the case relating to Department of Telecommunications (DoT) allocating additional spectrum that had allegedly led to a loss of '846.44 crore to the exchequer. The court had on August 31 reserved its order after hearing arguments on framing of charges.
The CBI had earlier argued that Ghosh had given additional spectrum to the telecom companies at “throwaway prices” causing a huge loss to the exchequer. Mr Ghosh had countered the CBI’s arguments saying private firms were not the only beneficiaries of surplus radio waves, but state-run MTNL and BSNL had also benefited.
