Kochi: The state government on Wednesday moved the Supreme Court against the Kerala high court order quashing the complaint registered against Jose Thettayil, MLA, on sexual abuse charges based on a complaint filed by a  woman from Aluva.

The high court had found that the complaint did  not contain the necessary facts  to attract section 376 (rape) of IPC. The state has sought to quash the  order passed by Justice P. Bhavadasan and to validate the FIR registered against Thettayil.

The state argued that the high court erred in exonerating the MLA. The victim in the case had earlier moved the apex court seeking a similar directive.
