Firm not to sell face wash till August 18

Chennai: The district consumer disputes redressal forum, Chennai (south), has restrained a cosmetic firm from selling facial wash gel after it found a dead cockroach in a bottle manufactured by it.

While passing an interim order, the bench, comprising president R. Mohandoss and member K. Amala, directed the firm and its agencies not to sell the adulterated facial wash containers till August 18.

The petitioner, T. Vadhanya, 25, of Tiruvotriyur, submitted that she purchased the face wash gel manufactured by Oriyanna Health Network Private Ltd, T. Nagar, for '275 from V Care Medspa Ltd, T. Nagar, on April 4, 2014. On reaching home, she found a dead cockroach in the bottle. Immediately, she informed the matter to V Care health clinic and the cosmetic firm.

On July 7, 2014, she sent a legal notice to them. As there was no response, she filed the petition with the forum seeking a compensation of '5 lakh for causing mental agony and adopting unfair trade practice.

The bench said, "The sealed bottle found to contain a little cockroach or fly-like organism which is not definitely part of face wash and as such it could be construed as an adulterated one unfit for human use. As such, the forum considers the petitioner made out a prima face which as per principle natural justice requires an interim order of injunction restraining the respondents not to sell such adulterated cosmetics/face wash till August 18, 2014". The bench has posted the matter for further hearing to the same day.
