Madras High Court warns Mayiladuthurai civic body office near dump yard
The bench said the counsel for TNPCB stated that nothing had happened till now
Chennai: Pointing to a PIL pending since 11 years, relating to shifting of a garbage disposal yard in Mayiladuthurai, the court has no option but to temporarily shift the office of the commissioner of Mayiladuthurai municipality right next to the dump. Till it was done, the Madras high court has granted 15 days, failing which the commissioner will remain personally present in court to facilitate his arrangements for sitting next to the dump.
A division bench comprising Chief Justice Sanjay Kishan Kaul and Justice M Sathyanaraynan posted further hearing of a PIL to September 12, filed by L. Rajendran in 2003, which sought to restrain the Mayiladuthurai Municipality from using the land in T S No 855/1 in Survey Ward 7, Mayiladuthurai Town as garbage disposal yard.
The bench said the counsel for TNPCB stated that nothing had happened till now.
“We have put to counsel for the municipality to plead with the commissioner that clearly he appears to be in breach of undertaking given in paragraph six of the counter affidavit. This court would thus have a little option but temporarily to shift the office of the commissioner right next to the dump till such time it is done. We would have passed this order, but for the counsel for the Municipality requesting for some time.
We grant 15 days’ time for the said purpose and a compliance report be filed within the same period of time, with no objection having been obtained from the TNPCB. Failing this the commissioner will remain personally present in court to facilitate his arrangements for sitting next to the dump,” the bench added.
