Hyderabad High Court asks police to continue probe

The Society and its 23 members had moved the High Court seeking quashing of the proceedings

Hyderabad: The Hyderabad High Court on Thursday refused to quash the criminal proceedings pending against office bearers of the Telangana Non Gazetted Officers’ Mutually Aided Cooperative Society. In February 2013, the Begum Bazaar police had filed a chargesheet against office bearers of the Society, including its president K. Swamy Goud, before the XVII Additional Chief Metropolitan Magistrate Court based on the directions of the lower court following a  private complaint by E. Venkatesham of the Telangana Non-Gazetted Officers’ Colony Welfare Association.

The complainant had sought a direction from the lower court for the police to conduct an inquiry into alleged gross violations in allotment of housing sites and misappropriation of funds by the office bearers of the Society. The Society and its 23 members had moved the High Court seeking quashing of the proceedings. After hearing the case, Justice S. Ravi Kumar observed, “As the compliant discloses prima facie material of misappropriation, I feel it is a fit case where the matter requ-ires thorough investigation.”

The judge ruled that the grounds for quashing the case were not tenable. Referring to apprehension of the petitioners about their arrest in the case, the judge directed the police to strictly adhere to Section 41 of the CrPC at the time of arrest of the petitioners in the case. After concluding that the case was fit for investigation, the judge dismissed the plea.
