NRI woman loses property papers, land
Encumbrance certificate revealed that property was sold to Ganesan by Loganayaki
Chennai: A woman non-resident Indian who lost her property documents 17 years ago, became a victim of land grabbing.
Originally, the disputed prime property in Sembium belonged to Arulmozhi and her daughter through partition. The land was registered in the sub-registrar’s office, Sembium, in 1996. The next year, they executed a power of attorney in favour of Susai Manickam.
Later, T. Loganayaki purchased the property and enjoyed the property without any interference. On June 23, 1998, Loganayaki lost the original documents on a bus in Kodungaiyur. She immediately lodged a complaint with the Kodungaiyur police.
Soon after, she went to Switzerland and has remained in that country since then.
In April 2012, Loganayaki came to know that someone was trying to put up a building on the land. The construction work was completed, and it was rented out for '25,000 per month. On a request from Loganayaki, S.T.G. Gangadaran of Anna Nagar visited the place and found that R. Ganesan of R.V. Nagar had grabbed the land and put up the building. The encumbrance certificate revealed that the property was sold to Ganesan by Loganayaki in 2002.
Counsel for Gangadaran, V.S. Suresh, said Loganayaki had never returned to India since 1998. The land was grabbed by Ganesan using forged documents. On December 18, 2012, Loganayaki had executed a general power of attorney in favour of Gangadaran in respect of the disputed property.
Following her request, Gangadaran filed a complaint against Ganesan with the central crime branch police on April 2, 2013. Since there was no action, he filed a writ petition before the Madras high court which directed the police to conduct an enquiry in accordance with law as early as possible.
On January 22, 2014, an FIR was registered, but the police failed to arrest the culprit.
After repeated requests, the police arrested Ganesan on August 27, 2014 and remanded him in prison. Ganesan filed a bail petition before the special court for exclusive trial of land grabbing cases, Periamet.
When the petition came up for hearing before the court, special metropolitan magistrate S. Indragandhi dismissed his bail plea.
