Madras High Court orders to register case against persons responsible for disturbances

Chennai: It is necessary that cases registered against persons responsible for causing disturbances following conviction of former Chief Minister and AIADMK general secretary J. Jayalalithaa, must be taken to logical conclusion, said the Madras high court. Disposing of a petition filed by advocate S. Jimaraj Milton, the first bench, comprising Chief Justice Sanjay Kishan Kaul and Justice M. Sathyanarayanan, said, “Criminal jurisprudence requires that offenders must suffer consequences of their action in accordance with law of the land.”
The petitioner sought to monitor the events that took place pursuant to the pronouncement of judgment against Ms Jayalalithaa by a Bengaluru special court on September 27. He sought the state to prevent agitation, demonstration, bandhs, stopping of buses, closing shops and disturbing public peace and tranquility in Tamil Nadu and to ensure that people live peacefully without any fear and threat as guaranteed under the Constitution.
The status report of the government said 7,404 persons were arrested for specific incidents and action in accordance with law initiated in connection with affixing of provocative posters and erection of banners and hoardings. As many as 180 cases were registered from September 27 to October 7, 2014 and 238 persons arrested. And, at present, normalcy is restored.
Advocate general A.L. Somayaji submitted that the investigation would be completed in all the cases and final report filed within eight weeks and compliance report submitted on February 24, 2015. Concurring with this, the bench said, “No further orders required except that this court considers it appropriate to monitor the issue and see that it is taken to its logical conclusion and it also serves as a deterrent for the future.”The bench closed another petition filed by PMK advocate K. Balu which challenged closure of schools and colleges by the managements for a day.
