Tamil Film Producer’s Council gets judge-receiver

Chennai: The Madras high court has appointed Justice A.K. Rajan, a retired judge of the Madras high court, as receiver to take charge and administer the Tamil Film Producer’s Council (TFPC), to maintain accounts and take care of day-to-day activities till fresh elections for the council were conducted and new office-bearers took charge.
Allowing the applications from S. Thanu and A.N. Pavithran, Justice S. Tamilvanan said the judge-receiver shall regulate and conduct fresh elections for the TFPC as per the bye-laws of the council by following principles of natural justice, within three months, and submit a report.
Originally, following disputes between the present office-bearers of the council and other members, suits were filed in the Madras high court.
The court had appointed Justice P. Shanmugham, a retired judge of the high court, as commissioner, to convene a special meeting with the agenda of a no-confidence motion.
The judge-commissioner conducted the meeting on May 11, 2014 and filed a report on May 14.
The judge-commissioner had held that a no-confidence motion was passed on a simple majority. Following this, various applications, including the applications of Thanu and Pavithran, were filed.
Silambanan, counsel for Thanu and Pavithran, submitted that the functioning of the TFPC was in a standstill due to the no-confidence motion passed against office-bearers of the council, and the council should immediately call for fresh elections in order to restore it to its normal functioning. He argued for appointment of a receiver, more particularly, a former judge of the court, to continue day-to-day functioning of the council till fresh elections were conducted.
The judge said the judge-receiver shall be the election officer to conduct the elections of the council, by issuing 21 days’ clear notice to all members, who are eligible to contest in the election and cast their votes and publication shall also be made in two daily newspapers, one in Tamil and another in English.
