Hyderabad: A division bench comprising Justice K.C. Bhanu and Justice Ms Anis on Thursday upheld an order of the Hyderabad bench of the Central Administrative Tribunal (CAT).
They directed the Centre to alter the date of birth of Dasari Srinivasulu and J.R. Anand, IAS officers in their service records and continue them in service till they superannuate on the corrected date of birth.
The bench was dismissing two appeals by the Union of India, represented by its under secretary of Department of Personnel and Training (DoPT) challenging the order of the Tribunal.
Both the officials moved the tribunal in 2014 separately challenging the orders passed by the Centre by rejecting their applications to rectification their date of birth. The Counsel representing the Centre said that it was the policy of the government not to correct the date of birth of any of the employees of the All India Services and that Rule 16-A (4) of the All India Services (Death-cum-Retirement Benefits) Rules, 1958 has no application because it was not a case of a bonafide clerical error.
