Government ticked off for not implementing pay scale

Chief secretary and finance secretary to appear before the court if recommendations were not implemented

Chennai: Pulling up the state government for not implementing the recommendations of the first national judicial pay commission, headed by Justice K. Jagannath Shetty, relating to the service condition of sub-court employees, including their pay structure, the Madras high court directed the chief secretary and finance secretary to appear before the court if the recommendations were not implemented in two months.
 
Though the state government assured the Madras high court in August 2014 that it would implement the recommendations from April 1, 2003, the government had not implemented it so far. When the petition filed by Tamil Nadu Judicial Ministerial Officers Association, represented by its general secretary T. Senthil Kumar, came up for hearing before the first bench comprising Chief Justice Sanjay Kishan Kaul and Justice T.S. Sivangnanam, government pleader S.T.S. Moorthy sought two more months.
 
The Chief Justice asked Moorthy what percentage the government spent on the judiciary. It is only a small allocation in the budget, compared to other departments, he said. The government has taken time to implement the recommendation of the Shetty commission keeping in mind the order of the Supreme Court, which have to be implemented from April 1, 2003. 
 
But, even after six months, the government is still unwilling to implement the recommendations. However, it is stated that already a part of the recommendations were implemented.The bench directed the government to implement the recommendations in its entirety within two months. The bench directed the chief secretary and finance secretary to appear before the court personally if the recommendations were not implemented in two months.
