No oral representation for prosecution: BV Acharya

Bengaluru: Special Public Prosecutor B.V. Acharya, who was appointed by the state government in the final stages of the disproportionate assets case against AIADMK supremo J. Jayalalithaa and three of her associates, said it was unfortunate that the prosecution was not given effective representation in the case.

He was given the position after the Supreme Court struck down the appointment of Mr Bhavani Singh as SPP in the case. Following the Supreme Court directions, Mr Acharya filed written arguments.

After studying the judment in detail, Mr Acharya is expected to discuss it with the state government and explore the possibility of challenging the judgment before the Supreme Court. 

On the contention of the State of Karnataka that it was not made a party, the high court in its judgment observed, “There was an observation by this court for the appearance of the Advocate General. Accordingly, he appeared before the court and made submission that he will give accommodation to the SPP Bhavani Singh. Even during that time, the AG did not mention about the accused not making state government as a party. On the other hand, B.V. Acharya, SPP, has urged the contention that the appeal is not maintainable, since the Government of Karnataka is not made as a party.”
