Special Public Prosecutor B V Acharya to take Jayalalithaa case to Supreme Court
The SPP’s recommendations comes a day after he pointed out glaring ‘arithmetical’ errors in the HC verdict
BENGALURU: Terming it as a ‘fit case,’ for an appeal in the Supreme Court, Special Public Prosecutor B V Acharya on Thursday has advised recommending the state government to file an appeal in the apex court against the acquittal of former Tamil Nadu Chief Minister Jayalalithaa and three others in the disproportionate assets case.
“I have given my opinion to the state government on High Court verdict acquitting Jayalalithaa, and three others in DA case ‘of all charges.’ I have said it is a fit case for an appeal to be filed in SC,” Mr Acharya told Deccan Chronicle.
The SPP’s recommendations comes a day after he pointed out glaring ‘arithmetical’ errors in the HC verdict on Jayalalithaa, and three other’s DA case.
On the day of HC verdict in the disproportionate assets case against Jayalalithaa, Mr Acharya had said that it was unfortunate that there was no effective representation of prosecution in the case.
Following SC directions, Mr Acharya was appointed as SPP, after SC struck down the appointment of Bhavani Singh as SPP in the case. Mr Acharya had only a day’s time to file his written arguments even as he stated that there was no opportunity for him to make oral arguments.
Insofar as the mathematical error pointed out by him, the DA in respect of Jayalalithaa would be around 77 per cent, and not 8.12 per cent as held by the HC, he had said. The HC while acquitting all the four including the principal accused Jayalalithaa has held that the DA is within the permissible of 10 per cent.
Meanwhile, BJP leader Subramanyam Swamy, a complainant, on Thursday tweeted, “I have decided to file SLP in SC after June 1st if Karnataka govdoes not file.”
