Stick to disabled quota, says Madras High Court

Chennai: The Madras HC has directed the municipal administration of Salem district and Attur municipality to fill up the existing vacancies to various posts in Attur municipality by following rules of reservation, particularly 3 per cent reservation to persons with disability as provided under the Disabilities Act.

Justice D. Hariparanthaman gave the directive while disposing of a petition from T. Dilip Kumar, a disabled person. Dilip Kumar, after passing class 10, registered at the Salem employment office. 
 
He met with a road accident in 2009 and his left leg below the knee was amputated. The doctor issued a disability certificate of 70 per cent disability. However, Attur municipality sought to fill up vacancies without following the reservation meant for persons with disability as provided under the Act, he added.
 
In its counter, the municipality submitted that it had received a list of eligible candidates from the Salem employment officer and vacancies were filled up based on this. The judge refused to regard this as a valid reason and directed the municipal administration and Attur municipality to fill up vacancies by following rules of reservation, particularly 3 per cent reservation for persons with disability.
