Hyderabad: P.V. Krishnaiah, an advocate of the Hyderabad HC moved a PIL on Friday seeking transfer of the ACB probe into the cash-for-vote scam to the CBI. The petitioner said that there is no possibility of a free and fair enquiry as the ACB is under the control of the Telangana government and it cannot act independently like the CBI.
He alleged that the video and audio clippings of the case were leaked to TV channels without the knowledge of the ACB. Citing the political uproar in AP and TS after the cash-for-vote scam, the petitioner said there is rivalry between the TRS and TD and the TRS is in power in Telangana. The ACB is under its control and cannot act independently like the CBI.
The petitioner sought a stay on all further proceedings including the ongoing probe by the ACB and an order to direct the TS government to transfer the case to the CBI. He also requested the HC to supervise the probe.
Land acquisition cleared:
The HC on Friday cleared the way for land acquisition for the right main canal of Indira Sagar Polavaram Irrigation Project pending since 2007 by partly modifying the status quo order granted on acquiring land. A division bench made it clear that the authorities of Indira Sagar Polavaram Irrigation project can carry on works on lands belonging to farmers who have already entered into an agreement with the government to part with lands for the project.
The bench was dealing with a petition by the AP government to vacate interim orders granted in 2007 on land acquisition. The court granted status quo on petitions by farmers from Krishna and WG districts challenging the notification.
AAG Dammalapati Srinivas of AP submitted that many farmers earlier agreed to give their lands for the project by entering into an agreement with the government but are not allowing authorities to carry out works due to the interim court order.
M.V. Durga Prasad, counsel for the petitioners submitted that the petitioner farmers of West Godavari had agreed to accept the compensation of Rs 31 lakh per acre offered by the government for their lands.
He said the petitioners from Krishna district sought time till June 23 to take a decision on the proposal of the government for paying Rs 36 lakh per acre in Krishna district. The bench made it clear that without reference to the proceedings pending before court regarding claimants who have settled their claims the respondents can proceed as per the settlement agreement. Granting time to Krishna district farmers till June 22 the bench said it will hear the matter on the day.
Case against YSRC MLA stayed:
Justice A.V. Sesha Sai of the HC on Friday stayed a case registered by the Dhone police against YSRC MLA B. Rajendranath for participating in a demonstration condemning the conduct of AP Chief Minister N. Chandrababu Naidu in the vote-for-note scam.
The police booked a case against the MLA and some others for holding the demonstration. Aggrieved by the police action the MLA moved the High Court. Senior counsel A. Sudarsan Reddy appearing for the MLA argued that when the Constitution allows people to convey dissent through peaceful means the booking of cases against it was unlawful.
The judge stayed further proceedings in the case.
