To acquire private land in Andhra Pradesh the Land Acquisition Act is not needed

HyderabadTo acquire private land in Andhra Pradesh the Land Acquisition Act is not needed. “Memorandum of Agreement” with the collector by the owners will do. To this affect AP government issued orders amending the rules of the Land Acquisition Act recently. The government said “the affected persons can come forward to opt for receiving higher compensation than calculated under the act and 
express willingness not to ask for a reference to land Acquisition, Rehabilitation and Resettlement Authority under the Act”.
 
According to government orders the district collector may initiate negotiations and arrive at a mutually agreeable compensation package reasonably higher than provided under the Land Acquisition Act. 
 
After that the district collector shall send a detailed proposal along with justification for the proposed package to concerned administrative department for approval. The government said the package shall be a lumpsum amount 
including all benefits like market value and others except value of assets attached to land or building for which the rate may be fixed by negotiation separately. 
 
The government may approve the proposal after being satisfied about the justification and reasonableness of the proposed compensation package and the value of structure in consultation with the department like Roads and Buildings, Horticulture etc wherever necessary. On receipt of the approval of the government the collector shall enter into an agreement in the shape of “Memorandum of Agreement” with the land owners and pass a final award with the compensation package and the value of structure / trees as approved by the government. Meanwhile, advocate and former Revenue Minister D.K. Samara Simha Reddy said if the affected persons give their consent on land acquisition it is legally valid.
 
In land pooling for the construction of the capital city in Guntur and Krishna districts the state government has followed almost the same procedure. But the compensation package is different. The state government has pooled around 30,000 acres for the new capital city.
