Supreme Court rejects plea on new capital city

New Delhi: The Supreme Court on Monday declined to entertain a plea seeking quashing of a law enacted by the Andhra Pradesh government for creating a new capital city.
A bench of Chief Justice H.L. Dattu and Justice Amitav Roy dismissed a writ petition filed by retired IAS officer M.G. Devasahayam seeking to declare as unconstitutional the law passed in December.
Mr Devasahayam, in his petition, said an expert panel appointed by the Centre had already submitted its recommendations for the new capital, but the state had passed the AP Capital Region Development Authority Act, 2014.
As per the provisions of the Act, the state government had empowered itself to declare the capital city and capital region area.
This, he said, was in contravention of provisions of both the Constitution and the AP Reorganisation Act. The petition said that the Act does not have the assent of the President of India.
