‘Nirapara’ moves court against ban

No prior notice was issued to the petitioner as mandated in the Act.

Kochi: ‘Nirapara’ on Friday filed a petition before Kerala High Court against the order of the Commissioner of Food Safety banning the sale of its  products  under the relevant provisions of the Food Safety and Standards Act of India. 
 
The  ‘Nirapara’ products are manufactured by KKR Food Products, Kalady.  The petitioner moved the court against Ms T.V. Anupama, Food Safety Commissioner,  and argued that she had misused her official powers and connived with others and passed the order under Section 36(3) (b) of the Food Safety and Standards Act, 2006.
 
No prior notice was issued to the petitioner as mandated in the Act. The petitioner  alleged that Ms Anupama's family had  personal rivalry and personal grudge with the family of the petitioner.  
 
Ms Anupama's in-laws are doing the same business and business rivalry is behind the whole episode, the petitioner said. 
 
Ms Anupama overstepped her jurisdiction and without any authority interfered in the matter and passed orders prohibiting the petitioner from manufacturing various products under the label, the petition said.
