Hyderabad: A division bench comprising acting Chief Justice Dilip B. Bhosale and Justice S.V. Bhatt of the Hyderabad High Court will hear a petition on Thursday challenging the amendments to the GHMC Act passed by the Telangana state government that shortened the poll schedule.
City resident Chakilam Raghunadha Rao moved the petition challenging the decision of the government to reduce the period of conducting polls to 15 days from 21-28 days by amending Section 33 of the GHMC Act.
The petitioner contended that the government had amended the Act on January 4 without citing valid reasons. He argued that amending a statute through an executive order is not permissible in law.
His counsel K. Anthony Reddy urged the bench to take up the hearing in view of the urgency as the State Election Commission could issue the notification for polls at any moment.
High Court declines to set aside order on GST
A division bench comprising acting Chief Justice Dilip B. Bhosale and Justice S.V. Bhatt of the Hyderabad High Court on Wednesday was not inclined to set aside an order passed by the National Green Tribunal, South Zone, to work on the proposed Bhadradri thermal power plant at Manuguru in Khammam district.
The Telangana state government had contended that the NGT had, on December 12, 2015, passed an ex-parte order to stop work on the plant following a petition by the Human Rights Forum alleging lack of environmental clearance for the proposed power plant.
The bench while expressing disinclination to set aside the order issued notices to the Human Rights Forum, Nationa Green Tribunal, the Union ministry of environment and the Telangana state Pollution Control Board to respond to the plea and posted the matter to after the Sankranti vacation.
