Karnataka High Court grants bail to woman accused of burying son alive
She was charged with offence punishable under Section 307 of IPC, for attempting to murder her own child.
Bengaluru: A gory incident was reported from a village in Chitradurga in September last year. A woman tried to kill her mentally challenged son by burying him alive in a ditch and covering it with pebbles.
Fortunately, the boy’s cries were heard by a shepherd, who rescued him and alerted the villagers. Jyothi, the accused mother was later arrested. The incident occurred at Kanchipura in Hosadurga taluk of Chitradurga district.
Jyothi had recently approached the High Court seeking bail and it was granted, subject to conditions. She was charged with offence punishable under Section 307 of IPC, for attempting to murder her own child.
The prosecution alleged that the boy is mentally challenged and she was reportedly fed up of taking care of him. She allegedly tried to finish him off on September 11 last year. She put him in a ditch and covered it with pebbles.
The boy survived with minor injuries and is now 14 years old. He is being taken care of by his maternal grandmother Nagamma. Jyothi was married to Srinivas, a coolie by profession, and they were facing financial difficulties, as he was an alcoholic.
The boy was born with a handicap and could not move on his own. He was being taken care of by his maternal grandmother, who was also drawing a monthly pension of Rs 500 for the upkeep of the specially-abled boy, as per a government scheme.
The boy’s mother reportedly demanded the pension money from Nagamma and when she refused she took away the boy.After the boy was rescued from the ditch, the Women and Child Welfare Department had provided assistance when he was hopitalised.
Jyothi was arrested the next day from Hosadurga Road and she had confessed to her crime. She said as her son was specially-abled, she would find it difficult to raise him.
"The accused being a woman of known identity and since the investigation has been completed, there is no impediment to enlarge the petitioner on bail," court ordered. However, it imposed certain conditions with directions to her to attend court proceedings regularly.
