CBI special court warns Karayi Rajan

According to the original bail condition, Mr Rajan should not leave Ernakulam district without the court's permission.

KOCHI: The CBI special court in Kochi on Thursday warned CPM leader and the Fazal murder case accused Karayi Rajan against not adhering strictly to its bail conditions.  The court made the warning while hearing a CBI petition citing his presence at the State Government’s film award presentation function in Thalassery. The defendant submitted that he visited the venue to meet his advocate. The CBI court warned him not to repeat such acts. He had got an exemption for attending a meeting of Kannur District Panchayat on September 10 and 11 as a member.

According to the original bail condition, Mr Rajan should not leave Ernakulam district without the court's permission. However, he'd gone to Kannur on September 9 and attended the award function on September 10 under the same police station limits where the Fazal got murdered. The CBI filed a report to cancel his bail in the wake of violations. He countered the report claiming that he went Kannur on September 9 to consult a doctor for his cour-month pregnant daughter. 

He also stated that he was at the venue only for 10 to 15 minutes to meet his lawyer and did not tamper with any evidence or influence witnesses. The court then asked the CBI whether it had any specific case of violation of bail condition to influence witnesses or tampering with the evidence. For this CBI replied that Mr Rajan being an influential person engaging in such things would directly affect the case.

Court then decided to warn him not to repeat such acts and decided not to invoke action under Section 439(1) of CrPC as per which court can cancel the bail.  The court also revoked its permission to stay in Thiruvananthapuram to work for the party's Chintha Publications.  He is the eighth accused in the Fazal murder case.
