Telangana High Court relief to Wakf Board, restores land to masjid
It sought a direction to the respondents not to alienate and not to alter the nature of the property pending disposal of the writ appeal.
Hyderabad: In a relief to the Wakf Board, the Telangana High Court on Friday restored the gazette notification pertaining to a parcel of prime land measuring 90 acres and 18 guntas in Guttala Begumpet, Madhapur, as belonging to Masjid Alamgiri.
A division bench comprising Chief Justice Thottathil B. Radha-krishnan and Justice A. Rajasheker Reddy restored the notification which had been suspended by a single judge.
On a writ petition filed by the Addagutta Coope-rative Housing Society represented by one B. Damodar, Justice M.S. Ramachandra Rao had on February 2 issued orders for the interim suspension of the Wakf Board gazette notifications 6 (File No. 21/LA (a)/RR/2015 dated February 8, 2018) and 25 (File No. 21/LA (a) /RR /2016 dated February 22, 2018) which had declared that the land in Survey Nos 1 to 9 of Guttala Beg-umpet, Serilingampally mandal, to be attached to the Wakf Alamgiri mosque.
The Wakf Board challenged the interim suspension before a division bench, seeking to suspend the operation of the orders passed in IA No 1 of 2019 in WP No 2328 of 2019, dated February 7. It sought a direction to the respondents not to alienate and not to alter the nature of the property pending disposal of the writ appeal.
After hearing both sides, the division bench modified the single bench order and revoked the interim suspension of gazette notification and directed that status quo be maintained and clubbed all petitions pertaining to the property.
