Hyderabad HC tells Telangana govt to clear stand on GO 152
Adjourning the case, the bench asked counsel to ascertain the stand of government and inform it.
Hyderabad: The Hyderabad High Court on Wednesday asked counsel appearing for the TS government to inform it by Thursday whether it would withdraw GO Ms No. 152 authorising the GHMC commissioner to regularise unauthorised construction, or not.
A bench comprising Acting Chief Justice Dilip B. Bhosale and Justice P. Naveen Rao was dealing with a petition by Forum for Good Governance, represented by M. Padmanabha Reddy, challenging GO Ms No. 146 issued on October 31, 2015 amending Section 455 – AA of the GHMC Act, 1955 and GO Ms No. 152 on November 2, 2015 to regularise illegal constructions in GHMC limits.
The bench told Mahender Reddy, special counsel appearing for the TS advocate-general, that if the government does not intend to withdraw GO No. 152, then the court will declare it illegal.
The bench pointed out the government rescinded GO Ms No. 146 which intended to amend Section 455- A of the GHMC Act and superseded it with an Ordinance, hence the other GO which intends to vest power of regularisation on the GHMC commissioner has to be withdrawn.
Adjourning the case to Thursday, the bench asked counsel to ascertain the stand of government and inform it.
HC seeks response from state to plea against Swamy Goud
Justice P.V. Sanjay Kumar of the Hyderabad High Court on Wednesday sought to know the status of a case registered against the then president of Telangana NGOs Mutually Aided Cooperative Housing Society and present chairman of TS Legislative Council K. Swamy Goud and others on alleged irregularities in allotment of plots.
The judge was dealing with Telangana NGO’s Welfare Association seeking a direction to hand over the investigation to the CBI. The petitioners alleged that Mr Swamy Goud, in his capacity as president of the Society, had indulged in several commissions and omissions in respect of allotment of plots, development of layouts etc.
Adjourning the case, the judge asked counsel representing the state government to submit the status report of the case by next week.
