People can move high court directly: Hyderabad HC

The bench remanded the matter to single judge with request to hear the case of the appellant afresh.

Hyderabad: The Hyderabad High Court on Monday held the land owners have a right to move the High Court under Article 300-A of the Constitution when their land was forcibly acquired by the government without invoking the Land Acquisition Act.

A division bench comprising Acting Chief Justice Ramesh Ranganathan and Justice K Vijaya Lakshmi on Monday set aside an order of a single judge, which directed the land owners to approach a civil court for the compensation.

The bench was dealing with an appeal by two women farmers from Karukonda village of Nagarkurnool district challenging the single judge order.

Mr Sarasani Satyam Reddy, senior counsel appearing for the appellant, submitted that the government has forcibly took away land of the appellants for construction of a reservoir bund without paying the compensation. When the appellants moved a writ before the single judge seeking to stay the construction, the single judge directed them to approach the civil court.

The bench remanded the matter to single judge with request to hear the case of the appellant afresh.
