Uttarakhand crisis: Supreme Court query on floor test
Court asked the AG to take instructions whether floor test can take place and President rule can be suspended for two or three days.
New Delhi: The Supreme Court on Tuesday asked the Attorney General Mukul Rohatgi whether ‘court monitored floor test’ can be held in Uttarakhand Assembly to prove the majority of former Chief Minister Harish Rawat, who has questioned the President’s rule.
On April 27, a Bench of Justices Dipak Misra and Shiva Kirti Singh while extending the President rule till May 3, said it will take up regular hearing from the day and indicated that it will examine whether a State can be brought under President rule on the only ground that the Appropriation Bill was not passed in the Assembly. In view of this interim order the floor test fixed by the High Court on April 29 could not take place.
On Tuesday, the court asked the AG to take instructions whether floor test can take place and President rule can be suspended for two or three days. In the perception of the bench even if the court upheld President’s rule, ultimately floor test is essential. Therefore it wanted the AG to consider whether the President’s rule can be kept in abeyance for three days to allow floor test to be monitored by the court.
