CBI's stand on plea against Ilaiah sought
When the judge sought a response from counsel for the CBI, he replied that he will file a counter affidavit.
Hyderabad: The Hyderabad High Court on Tuesday asked the Central Bureau of Investigation to give its stand on maintainability of a petition moved against Prof. Kancha Ilaiah seeking a CBI probe into a book Komatlu Samajika Smugglerlu (Komatlu Social Smugglers) authored by him.
Justice Challa Kodandaram, while dealing with a petition by World Arya Vysya Mahasabha, asked Penjuri Venugopal, counsel for the petitioner, how could the CBI probe the contents of a book and how could the court order a CBI probe.
Counsel said that Prof. Ilaiah is a public servant and when a public servant attempted to creating disturbance in the society by provoking and targeting a particular community, the court has to intervene and order a probe.
When the judge sought a response from counsel for the CBI, he replied that he will file a counter affidavit.
The judge said that the question of filing the counter affidavit will arise when the petition was admitted; herein the petition was at admission stage. The judge asked counsel to spell the stand on the maintainability of the petition.
In another petition by Ms Vattsala, resident of Pedda Gollapalli village in Prakasam district, the judge asked counsel for the home department of AP to get instructions on the averments of the plea by October 12.
The petitioner urged the court to declare as illegal the failure of the Kanigiri police to register a case against Prof. Ilaiah for his alleged provocation that has led to great disturbance and chaos in AP and TS.
