Jubilee Hill police can probe NRI case: Lawyers
The police sought legal advice if they can file and investigate a case which has already been investigated by the police of another state.
Hyderabad: Though the Jubilee Hills police sought legal opinion on the investigation of the murder of NRI industrialist Chigurupati Jayaram, legal experts say that the police need not wait as the law says the place of offence is the main ground for investigation.
The police sought legal advice if they can file and investigate a case which has already been investigated by the police of another state.
“It is clear, case can be registered anywhere, the moment the first information report is submitted. But, during the course of investigation, if the investigation officer finds that commission of offence has not taken place in the territorial jurisdiction, then his duty is to transfer the case to the police station under whose jurisdiction the offence had occurred. In the case of Jayaram, the place of offence is Hyderabad. The AP Police will invariably have to transfer the case,” said senior advocate C. Mallesh Rao.
On Tuesday, wife of the victim Padmasree, lodged a complaint with the Jubilee Hills police requesting that the case be investigated in Hyderabad.
She alleged that the AP Police may dilute the case. She criticised that she did not get the post-mortem report till date even after asking them many times.
