Counsel appearing for the petitioner urges the court for some time to file affidavit.
Hyderabad: K.E. Shyam Babu, the son of K.E. Krishnamurthy, the Deputy Chief Minister of AP, has moved the Hyderabad High Court and challenged an order of the Junior First Class Magistrate Court of Dhone in Kurnool district.
The Magistrate Court took cognisance of a private complaint filed by Ms Sri Devi, the wife of YSRC leader Lakshmi Narayana Reddy, urging the court to name K.E. Shyam Babu, as well as ZPTC member K. Bojjamma and Sub-Inspector Naga Chaitanya Prasad, as the accused in the murder of her husband and book them under Sections 147, 148, 149, 302, 109 and 120 (B) of the IPC and Sections 3 and 4 of the Explosives Act.
Lakshmi Narayana Reddy was killed on May 21, 2017, The Krishnagiri police of Kurnool district had initially booked a case against Mr Shyam Babu and Ms Bojjamma. But they later excluded their names while filing the charge sheet before the trial court. Ms Sri Devi then filed a private complaint before the Magistrate Court. The Court took cognisance of her complaint and issued non-bailable warrants against Mr Shyam Babu and Mr Naga Chaitanya Prasad. Aggrieved by the action of the Magistrate Court, Mr Shyam Babu approached the High Court seeking a stay on the proceedings of the lower court.
When the case came up before Justice Shameem Akhter, advocate Ponnavolu Sudhakar Reddy appearing for Ms Sri Devi submitted that the petitioner had failed to make a proper prayer seeking to quash the proceedings and that the petition was liable to be dismissed on those grounds. P. Veera Reddy, senior counsel appearing for the petitioner, stated that a typographical error had occurred during the preparation of the affidavit. He urged the court to grant them some time to have the affidavit amended. The judge granted the petitioner time to file the amended affidavit and posted the case to Wednesday.
