Builder ordered to pay Rs 1.05 lakh for damages

Builder failed to give possession of house on time.

Hyderabad: The State Consumer Disputes Redressal Forum has ordered the Pride India Mansions private limited, to pay Rs 1,00,000 for deficiency of services and 5,000 towards costs to the complainant, Syed Sultanuddin, 60, a resident of Hussain Alam, Hyderabad.

The complainant stated that he bought an independent house of 150 sq yards, Plot no. 18D at Orchid Residency in Ballapur village, Ranga Reddy district, for Rs 18,55,000 from Pride India Mansions on November 25, 2014, but he did not get the vacant possession in the stipulated time period of 12 months, according to the sale of agreement.  

When the complainant went and checked the site he found that the quality of material used for the construction of the house was also of low quality and complained to the authorities about the drawbacks, but in vain. 

So the complainant urged the opposite party to conduct an inspection of the site and then the opposite party appointed an engineer, who gave a review report on August 10, 2016. 

Pride India Mansions rebutted the contention made by the complainant stating that they had completed the construction of house in all aspects according to the specifications mentioned in the agreement of sale. 

It was the complainant who had not come forward to take possession of the house within the stipulated time period, the said. 

However, the report given by the engineer appointed by Pride India Mansions had listed quite a lot of defects in the construction of the house, which made the house unsuitable for living.
