Madras High Court restraint on PMK over Kanchi conference

Chennai: The Madras high court on Wednesday restrained PMK from proceeding with the preparation, temporary construction or making arrangements for conducting a state level political conference, scheduled to be held on February 14 on the site in question viz., VGP Thidal in Kancheepuram district.

A division bench comprising Justices Satish K. Agnihotri and Justice M. Venugopal passed the interim order on the appeals filed by the DGP, Kancheepuram superintendent of police and collector and three others, challenging an order of a single judge, granting permission to PMK to hold the conference at VGP Thidal.

The authorities contended the PMK sought permission to conduct the conference in the lands under litigation that had been declared surplus from M/s Kasthuri Estate at the Vandalur-Urapakkam. In this connection, the RDO and the DSP have filed counter affidavit separately in the petition. But the court erroneously allowed the petition without considering all the relevant facts and circumstances.

The bench said the dispute in respect of ownership between parties came up for consideration in an appeal, where under a division bench of this court, passed an order “Notice. All the parties are restrained from alienating, transferring and creating any encumbrance on the property in question”.

It was brought to the notice of this court that subsequent to the order, the VGP has given consent. The single judge in the impugned order dated January 29, while considering the petition filed by the PMK observed that the interim order passed by the division bench does not come in the way of granting permission to hold the meeting. Counsel appearing for VGP sought a day to obtain instructions.
