PIL on creation of new districts filed in Hyderabad HC

Hyderabad: A PIL has been filed in the Hyderabad High Court challenging the preliminary notification issued by the TS government on the new districts proposal, particularly with regard to reorganisation of districts, revenue divisions and mandals in Khammam, Warangal and Adilabad.

Adivasi Sankshema Parishad, represented by P. Srinivas, moved the plea seeking stay on the notification to the extent of the Scheduled area, contending that the state government has no power to reorganise the areas which fall under the agency under Schedule V of the Constitution.

Mr Srinivas said that only the Governor had the power either to reorganise or form new mandals and districts in Scheduled areas. He submitted that as per the Constitution, the Governor and the Tribal Advisory Council chairman alone can receive objections with regard to reorganisation and the collectors have no role or power in this issue. The boundaries of a scheduled area can be notified only by the President after the consultation with the Governor.
