Abnormal delay in filing of the charge sheet also leads to acquittal
Hyderabad: C. Mallesh Rao, senior criminal lawyer, who had appeared in the multi-crore Telgi stamp paper scam and the coal scam involving Jharkhand’s former chief minister Madhu Koda, says that senior CBI officers meddling in investigations is one of the main reasons most cases investigated by the Central Bureau of Investigation end in an acquittal.
He says that what has come to be known as CBI vs CBI has exposed this. CBI officers have expertise in economic offences cases and also offences under the Prevention of Corruption Act. But in recent times, many bodily offence cases criminal cases have been transferred to the CBI and these are leading to acquittals because the agency does not have the required expertise to handle such cases.
Even the Supreme Court had no jurisdiction to interfere in the investigation of a criminal case, he added.
In the Telgi scam, the CBI took over 10 years to file the charge sheet that too after the intervention of the Hyderabad High Court. Abnormal delay in filing of the charge sheet also leads to acquittal
He said that the other drawbacks that impact the probing rate include archaic infrastructure, and delay in modernisation of the CFSL.
