Hyderabad: The Hyderabad High Court has stayed a notification issued by director general of foreign trade permitting the import of Maize (Corn) without restriction of the Actual User Condition.

Justice A. Rajasheker Reddy while dealing with a petition by Sriven Marketing represented by its proprietor Venu Akula seeking to declare the all imports of Maize (Corn Popcorn) made and already cleared under the Duty Free Import Authorisation Scheme under Chapter 4 of the Foreign Trade Policy 2015-2020 as illegal.

While granting the stay, the judge pointed out that the grievance of the petitioner is that Foreign Trade Policy of the Centre cannot be throttled with by the DG of foreign trade by exercising his power under the Law.

The judge noted that “in fact the DG of Foreign Trade has no power to interdict the said exercise. More so , this court has interdicted when respondent authorities tried to permit import of Maize without restriction of actual user .”

The judge pointed out that the DG of Foreign Trade issued the notification despite the status quo granted by this court earlier.
