Madras High Court issues notice to Tamil Nadu Wakf board
It was sought to quash an order of the government appointing Thamilmahan Hussain.
Chennai: The Madras high court has ordered notice to the state government and Tamil Nadu Wakf Board on a petition, which sought to quash an order of the government appointing A. Thamilmahan Hussain as a member of the TN Wakf Board.
Justice K. Ravichandrabaabu before whom the petition filed by A.K. Rafi Baig came up for hearing, ordered notice and posted after three weeks, further hearing of the case.
According to petitioner, section 14 (1) (C) of the amended Wakf Act contemplates that one person among Muslim who has the personal experience in Town Planning or business management, social work, finance or revenue, agriculture and development activities to be nominated by the state government. The present nomination, issued by the government, nominating Thamilmahan Hussain does not disclose in which field he was having professional experience. Apart from the said fact, no notification was issued by the government for inviting the application to be nominated under the clause of personal and professional experience in various fields as contemplated under section 14 (1) (C) of the Act and person in Islamic Theology. In so far as the advocate from Bar Council of TN was concerned, the government called for a list from the Bar Council and out of the list they have selected two advocates. In so far as the nomination of Thamilmahan was concerned, there were no other applications invited from any proficient person from various fields and the government has arbitrarily appointed him without inviting any application from common public, he added.
