Deal litigations case-wise, says Telangana HC

Hyderabad: The full bench of the Telangana state High Court said that the pending cases of the erstwhile Hyderabad High Court that involved Telangana state and Andhra Pradesh states should be dealt with on a case-wise basis, preferably at the Telangana High Court.

Further, all pending contempt cases, writ appeals and review petitions related to the region of Andhra Pradesh must be transferred to the AP High Court.

A full bench comprising Chief Justice Thottathil B. Radhakrishnan, Justice P.V. Sanjay Kumar and Justice A. Rajaseker Reddy, on Tuesday, pronounced the judgement on a taken-up petition based on a letter from the AP High Court Advocates’ Association with a plea to issue directions to the registry to transfer writ appeals, review petitions, contempt cases and so on related to AP to the AP HC.

The bench said that in the present circumstances, it would be advisable to transfer the writ appeals on hand and all such other matters which would come within the ambit of Section 40 (3) of the AP Reorganisation Act, including contempt cases, review petitions and applications seeking leave to approach the Supreme Court in relation to the orders passed by the erstwhile common High Court at Hyderabad, to the newly constituted AP High Court at Amaravati.

However, the bench felt that the decision to transfer cases would come under the administrative powers of the Chief Justice of the Telangana High Court, and directed the registry to place all these writ appeals and similar cases before the Chief Justice for passing appropriate orders.
