Karnataka: Plea filed against choice of High Court judges

The Advocates Association Bengaluru on Dec 16 passed a resolution, claiming that six advocates recommended for the posts were Brahmins.

If the authorities failed file the status report, the court would issue contempt notice against the two officials, said the judges.

Bengaluru: A city advocate has filed a PIL seeking to stay the recommendations made by the Karnataka High Court collegium to the posts of High Court judges. He has stated that a majority of the names recommended were from a single community, which is against social justice and opposed to the law in the National Judicial Appointment Commission.

“The task of the collegium is to assess suitable candidates giving opportunity to all the sections of society and recommending persons having regard to their social order for the appointment to the HC judge's post. This has not been done in this case," the petition stated.

The PIL cited an SC judgment, which stated, “Appointment can’t be exclusively made from any isolated group nor should it be predominated by representing a narrow group. Diversity, in judicial appointment to pick the best legally trained minds coupled with a qualitative personality, or the guiding factors that deserved to be observed uninfluenced by mere considerations of individual opinions.” The PIL, which came up before a bench headed by Chief Justice S.K. Mukherjee, will be heard by another bench.
