Hyderabad: Willing to hear more arguments of the petitioners on the impending demolition of Errum Manzil, the Telangana High Court adjourned the cases to Monday. On Monday, it wanted to know from the state government about the exact spelling of the palace.
Referring to the State Gazette which spelled it ‘Erram Manzil’, which is different from ‘Irrum Manzil’ as named in the Telangana state Cabinet’s agenda, the division bench comprising Chief Justice Raghavendra Singh Chauhan and Justice Shameem Akther asked Additional AG J. Ramachandra Rao to inform it by Monday, whether the initial letter is ‘E’ or ‘I’.
The bench which has been hearing the arguments on the seven PILs filed against government’s decision to demolish the building to construct a new Assembly for consecutive days in a row from four days, decided to hear the case on a daily basis without adjournments.
Justice Chauhan said that the case will be heard in a long spell in the coming week till the conclusion of arguments.
On Friday, Mr Rama Kanth Reddy, counsel for the Mr Omim Maeckshaw Debara, president of the NGO COVA, submitted that under the Urban Development Act in 1998 and Under HMDA Act in 2009, the Errum Manzil was declared as a heritage monument.
He said this tag cannot be removed by government orders, and decisions are taken by previous governments cannot be nullified with retrospective effect after a lapse of more than two decades. The counsel submitted that the decision to demolish is a violation of fundamental rights of the dead noble Fakhr ul Mulk Bahadur and the ancient monument comes within the definition of a person.
