PIL against Sasikala dismissed as withdrawn

As it has become infructuous following her conviction and sentence in the disproportionate assets case.

New Delhi: The Supreme Court on Friday dismissed as withdrawn a writ petition filed by Satta Panchayat Iyakkam against the swearing-in of Ms. V.K. Sasikala as Chief Minister of Tamil nadu as it has become infructuous following her conviction and sentence in the disproportionate assets case.    

A Bench of Chief Justice J.S. Khehar and Justices N.V. Ramana, D.Y. Chandrachud and Sanjay Kishan Kaul  permitted counsel G.S. Mani to withdraw the petition. When counsel pointed out that the court should frame guidelines whether convicted persons, who are not Members of the Legislature can be appointed as Chief Minister by the Governor undere Article 164 (4) of the Constitution, the CJI said “we will consider it as and when you bring us such a situation.”     

The PIL said that appointment of a non MLA as a Chief Minister without a declaration of assets and criminal back ground which is normally done when a candidate contests as election is not permissible in law as people are not aware his/her antecedents.
