Hyderabad HC upholds detention of Nayeemuddin's close aide

The complaints were based on confessions of co-accused and Goud had no role played in the incidents, the counsel said.

Hyderabad: The Hyderabad High Court has upheld the detention of N. Sridhar Goud, a close associate of slain gangster Nayeemuddin, under the Preventive Detention Act, 1986 by the Rachakonda police.

A division bench comprising Justice P.V. Sanjay Kumar and Justice Shameem Akhter was dismissing a habeas corpus petition filed by Goud’s wife.

His counsel contended that the order of detention was passed in a mechanical manner without application of mind on “vague, irrelevant and non-existent grounds” describing eight incidents  between January 21 and August 18, 2016. 

The complaints were based on confessions of co-accused and Goud had no role played in the incidents, the counsel said.

The Rachakonda police commissioner submitted that he was a “goonda” and had been habitually committing grave and gruesome unlawful activities like  kidnapping, extortions, murders, attempts to murders, criminal trespass, land grabbing, etc., affecting public order.  

This created fear and a feeling of insecurity among the people, the police officer told the court.

Justice Sanjay Kumar and Justice Akhter said that it was evident from Goud’s record that he and the other accused “habitually, continuously” committing offences punishable under the Indian Penal Code and other laws. His activities had a prejudicial effect on society as a whole, as well as public order, the court said.
