Hyderabad High Court okays promotion of head constables as SIs
While considering the request of the authorities, the judge modified the interim order.
Hyderabad: The Hyderabad High Court has cleared the way for the promotion of head constables and sub-inspectors in Telangana state by modifying the stay granted earlier.
Justice M. Seetharama Murti, while dealing with an vacate stay application of the principal secretary of the home department of Telangana state, modified the stay order granted on March 16, 2018, reserving liberty to the authorities to take up the exercise of promotions to the posts of head constable and sub-inspectors including drafting of eligible promotees to the pre-promotional training as per the rules, by also considering the cases of petitioners in this case.
The judge made it clear that the consideration of the case of the petitioners for pre-promotional training and their promotions pursuant to this order shall be subjected to the result of the writ petitions and they shall not be entitled to claim any equities in future.
Earlier, the court had granted a stay while dealing with the petition filed by Y. Ranga Reddy and seven others seeking to declare the action of the authorities in applying weightage formula to head constables or constables who were transferred from the Andhra Pradesh Special Police Battalions to the Armed Reserve Police prior to Jan 1, 2006, and revising their seniority which was settled long back as illegal.
The authorities contended that the petitioners are only eight in number and vacancies of the respective posts are in hundreds and due to stay they are unable to fill the vacancies of head constables and sub-inspectors through promotions.
While considering the request of the authorities, the judge modified the interim order.
