Telangana High Court penalises man for filing false petition, misuse of law

Hyderabad: A 23-year-old man who filed a habeas corpus petition that his distant relative, a woman, was missing and sought the Telangana High Court’s intervention, was penalised by the court with Rs 50,000 for filing a false petition and misusing the law.
The High Court last week, received a habeas corpus petition from Vaspari Mallesh, 23, a resident of Pavanapuri Colony in Rangareddy district that the woman he loved, his distant relative, was detained by her father and brother-in-law. They had lodged a false complaint against him by forcing the woman.
On August 13, 2019, Saroornagar police arrested Mallesh following a complaint from a woman that he was harassing her. A case was registered under sections 354 D, 504 and 506 of IPC and section 43 r/w 66 of the IT Act.
The petition was considered by the court and a division bench of the High Court of Telangana comprising Mr. RS Chouhan, Chief Justice, and Justice A Abhishek Reddy. On Tuesday, the bench examined the victim and police, and found that the claims of Mallesh were false. They gave a judgement directing him to pay Rs 50,000 as penalty within two weeks for misusing the law.
