HMDA fails to stop registration
However, lacunae in existing registration laws meant there are no brakes on law violators.
HYDERABAD: Efforts by the Hyderabad Metropolitan Development Authority to stop registration of lands in unapproved layouts are going in vain due to the current registration rules.
To overcome the headache of unapproved layouts mushrooming in its jurisdiction spread over seven districts on the city outskirts, the urban body has decided to use the help of the stamps and registrations wing.
However, lacunae in existing registration laws meant there are no brakes on law violators.
The urban body has sent a communication to registration officials not to register unapproved lands in Boduppal and Balapur.
Realtors and individuals are trading in properties in violation of rules and then going in for regularisation to make them legal. The registration officials are not stopping registration of plots citing rules, said an HMDA official.
According to Section-22-A (1) (e) of the Registration Act No.19 of 2007, registration of government land as well as assigned, ceiling, prohibited, shikam land is prohibited, but there is no mention of any unapproved layouts in it.
The Tamil Nadu government has amended its registration laws for unapproved layouts and hence no registrations are being done there. The need of the hour is a similar step in Telangana state, an official said.
According to HMDA chief T. Chiranjeevulu, the urban body had written to the government to amend the laws so that no registration takes place for unauthorized layouts. Law violators using the LRS as an option to make their properties legal, he said.
Director Purushotham Reddy stated that no one would dare to make an unauthorised venture and sell plots if government bars the registration of such parcels of land.
