Hyderabad High Court stays GO reserving posts only for women
As per GO all teaching and non teaching posts were reserved only for women in the schools run by various welfare departments in the state.
Hyderabad: The Hyderabad High Court on Wednesday suspended a GO issued by the TS government seeking to fill teaching and non-teaching posts with only women in residential schools run by Social, BC, ST and Minority Welfare departments of the state.
Justice M.S. Ramachandra Rao, while admitting a petition by K. Satyanarayana of Warangal and another, challenging GO No. 1,274 issued on June 4, 2016, granted the interim order.
Senior counsel Sarasani Satyam Reddy, appearing for the petitioners, submitted that as per the GO, all teaching and non teaching posts were reserved only for women in the schools run by various welfare departments in the state.
Mr Reddy said that the GO itself was in violation of the Right to Equality which is Fundamental Right enshrined in Articles 14 and 16 of the Constitution.
Counsel appearing for the TSPSC while opposing the petition, submitted that the notification for the recruitment was already issued and the government has the power under the Subordinate Service Rules to reserve posts only for women.
While pointing out that the Rules specified ‘only for preference’ and not 100 per cent reservation, the judge granted interim suspension of the GO and issued notices the respondents directing them to file counter affidavits.
